Terms of Service

1. Parties and acceptance

These Terms of Service ("Terms") govern the relationship between AgencyRadar ("Service", "we") and the individual or legal entity registering for the Service ("User", "you"). AgencyRadar is currently operated by an individual operator; once incorporated, the legal entity name, tax/business registration number, and full business address will be added to this page. By creating an account or using the Service, you accept these Terms. If you don't accept these Terms, don't use the Service.

2. Description of the Service

AgencyRadar is a B2B website intelligence, CRM, and AI-assisted sales workspace for digital agencies and freelance web designers. The Service includes: technical/conversion scanning of business websites entered by the user or found via the public business opportunity discovery tool, deterministic scoring of business activity and commercial opportunity signals, discovery of business contact information from public and legal sources, sellable service suggestions, AI-assisted draft sales messages, and a CRM flow. Scores are calculated with deterministic rules; AI is used only to summarize findings and draft messages, never as the scoring engine.

The scores and findings produced are based on public sources accessible at the time of the scan. A technical shortcoming on a website does not by itself mean that business is active or intends to buy; the final assessment and sales decision belong to the user.

AI-assisted message drafts are sent one at a time from a connected Gmail account only after the user reviews and approves them; no email is ever sent automatically without user approval. The Service does not provide bulk spam, automated cold email sequences, or purchased marketing lists.

3. Account creation and security

You are responsible for providing accurate, up-to-date information when creating an account. You are responsible for the confidentiality of your account credentials and for all activity carried out through your account. If you suspect unauthorized access to your account, notify us immediately at merhaba@agencyradar.com.tr.

4. Subscription, trial period, and payment

Starter, Pro, and Agency plans are offered on monthly or yearly billing; current prices are shown on the pricing page. New users can start a 3-day free trial; a card is required to start the trial, but you won't be charged during the trial period. At the end of the trial you're automatically moved to the Starter monthly plan and billing begins; if you cancel any time before the trial ends, you won't be charged.

Payments are processed through our payment provider Paddle, acting as Merchant of Record; invoicing, VAT/tax calculation, and storage of card details belong to Paddle — your card details are never held on our servers. Subscriptions renew automatically at the end of each period unless canceled.

5. Cancellation and plan changes

You can cancel or change your plan at any time from the "Manage Subscription" link on the Settings → Billing page, via the payment provider's self-service portal. Cancellation takes effect at the end of the current billing period; no refund is issued for unused time within the period. See the Refund Policy page for refund terms.

6. Credit system and usage limits

Operations such as business discovery, website scanning, AI analysis, and outreach message generation are deducted from your plan's credit balance. Once your credit balance is exhausted, you can't perform the related operation; you can continue by purchasing additional credits or upgrading your plan. To prevent abuse, rate limits and bulk/automated usage limits apply to all accounts.

7. Acceptable use

You may not use the Service for uncontrolled data scraping that violates terms of use, unlawful collection of personal data, automated bulk email sending without user consent, or access that violates third parties' (e.g. LinkedIn) terms of use. Scans are subject to rate-limit, concurrency, and quota rules to control server cost and prevent abuse.

8. Opportunity visibility and exclusivity

Opportunities may be offered under shared, limited (open to a limited number of users), or exclusive (reserved for a single user for a set period) visibility models. Exclusive reservations are subject to payment/credit verification, time limits, and contact-quota rules, and may be canceled if abuse is detected. How many users an opportunity is open to, and under which model, is shown clearly on the record itself.

9. Data accuracy and disclaimer

Scores and findings are based on public and legal sources accessible at the time; they do not constitute a guarantee of revenue, budget, or sale. The Service is provided "as is"; the analysis, scoring, and contact information provided do not guarantee any commercial outcome, revenue growth, or client acquisition. The user is responsible for reviewing generated sales messages before sending them and for using the information obtained responsibly in their own business decisions.

10. Intellectual property

The AgencyRadar software, interface, scoring methodology, and brand belong to us. Using the Service grants you only a limited, non-transferable license for personal/organizational use; you may not reverse-engineer, copy, or resell the Service.

11. Suspension and termination

We may suspend or close, with or without warning, accounts that violate these Terms or the acceptable use rules. You can close your account at any time from Settings; closing terminates the subscription at the end of the current billing period.

12. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from use or inability to use the Service. Our total liability is limited to the subscription fees you paid in the 12 months preceding the event giving rise to the claim.

13. Changes

We may update these Terms from time to time. You'll be notified of material changes via your registered email or within the product. Continuing to use the Service after updated Terms are published means you accept the changes.

14. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye. Turkish courts and enforcement offices have jurisdiction over any disputes.
